1. Purpose

These Terms of Service govern the use of Dear, Ami (the “Service”) and set forth the rights, obligations, responsibilities, and other necessary matters between the user and the operator of the Service.

2. Overview of the Service

Dear, Ami is an AI character chat service that allows users to have conversations with fictional AI characters.

To provide a smooth conversational experience, the Service may use the following AI features:

  1. Conversation model: generates natural conversations with AI characters.
  2. Memory model: references important information or preferences from past conversations.
  3. Image model: allows AI characters to generate and send photos or images.

Dear, Ami may operate by connecting the user’s smartphone to a PC or local AI environment configured by the user.

3. Notice Regarding Fictional AI Characters

All characters provided in Dear, Ami are fictional AI characters.

The names, images, personalities, speaking styles, and responses of the characters do not represent or speak on behalf of any real person, organization, institution, or third party.

Users must not mistake the characters for real people. Users understand that AI character responses do not represent real human statements, opinions, promises, or professional advice.

4. Limitations of AI Responses

Responses generated by Dear, Ami are automatically generated by AI and may not always be accurate, complete, appropriate, or up to date.

AI responses are provided for reference only and do not replace professional advice, including but not limited to:

  1. Medical, health, mental health, or psychological counseling
  2. Legal advice
  3. Financial, investment, or tax advice
  4. Safety-related decisions or emergency situations
  5. Any matter requiring the judgment of a qualified professional

Users should verify important information with appropriate professionals or reliable sources before making decisions.

5. Data Storage and Processing

Dear, Ami may not require account registration. In principle, the user’s chat history, long-term memory, character settings, local server address, and related app data are stored on the user’s smartphone.

The operator does not store the user’s chat content, long-term memory, or personal app settings on a separate operator server.

However, the Service may retrieve non-personal operational data from external servers, such as notices, app configuration values, content information, and version information.

Depending on the configuration of the user’s PC, local AI server, Ollama, ComfyUI, Tailscale, or other third-party tools, logs or records may remain in those environments. The user is responsible for managing such environments.

6. Local AI Environment and Third-Party Tools

Dear, Ami may connect to a local AI environment installed and configured by the user.

To use certain features, users may optionally use third-party or open-source tools, including but not limited to:

  1. Ollama: used to run or call conversation and memory models
  2. ComfyUI: used to run or call image models
  3. Tailscale or similar networking tools: used to support secure connections between the smartphone and the user’s PC

These tools are provided separately from Dear, Ami and may be subject to their own terms, privacy policies, installation requirements, account requirements, data practices, and security practices.

Dear, Ami does not guarantee the installation, operation, stability, security, updates, compatibility, or data processing practices of third-party tools.

7. User Responsibilities

Users are responsible for:

  1. Managing the security and configuration of their smartphone, PC, network, local AI server, and third-party tools
  2. Backing up and managing chat history, long-term memory, and app settings stored on the device
  3. Evaluating the appropriateness, accuracy, and safety of AI responses
  4. Using the Service in a manner that does not infringe the rights, reputation, privacy, likeness rights, copyrights, or other rights of third parties
  5. Complying with applicable laws and these Terms

Chat history, long-term memory, and settings stored on the smartphone may be lost if the app is deleted, the device is reset, data is erased, the device is changed, or backups fail. The operator is not responsible for such loss.

8. Prohibited Conduct

Users must not engage in any of the following activities:

  1. Impersonating or misleading others into believing that an AI character represents a real person, celebrity, private individual, organization, or institution
  2. Using another person’s photo, name, personal information, likeness, voice, or copyrighted work without consent
  3. Generating, requesting, or sharing illegal, violent, hateful, discriminatory, sexually explicit, or minor-inappropriate content
  4. Improperly entering, storing, collecting, or disclosing another person’s personal or sensitive information
  5. Exploiting vulnerabilities or bypassing security features of the Service or third-party tools
  6. Infringing the rights, reputation, goodwill, or business interests of Dear, Ami or any third party
  7. Violating applicable laws, public order, good morals, or these Terms

If prohibited conduct is identified, the operator may take necessary actions, including restricting access to the Service, limiting features, requesting content removal, or taking other appropriate measures.

9. Images and Generated Content

The Service may provide AI-based content, including AI character images, conversations, and generated images.

AI-generated content may contain unexpected errors, inaccuracies, inappropriate expressions, or results that differ from the user’s expectations.

Users must comply with applicable laws, third-party rights, platform policies, and social standards when using AI-generated content.

10. Intellectual Property

All rights related to the Dear, Ami app, design, user interface, logo, brand, character settings, default content, and service structure belong to the operator or the rightful owner.

Users may not copy, distribute, modify, reverse engineer, sell, lease, reuse, or commercially exploit all or part of the Service without prior consent from the operator.

Rights to content directly entered by the user and data generated or stored in the user’s local environment are subject to applicable laws and separate policies.

11. Changes or Suspension of the Service

The operator may change, suspend, or discontinue all or part of the Service due to service improvements, security needs, technical requirements, policy changes, changes to third-party services, or other operational needs.

Where reasonably possible, the operator will notify users of important changes through in-app notices, documentation pages, or other appropriate methods.

12. Disclaimer and Limitation of Liability

Dear, Ami does not guarantee that the Service will always be available without interruption, operate without errors, or be compatible with all devices, operating systems, local AI environments, or third-party tools.

The operator is not responsible for damages arising from:

  1. Errors in the user’s device, PC, network, local AI server, or third-party tool configuration
  2. Failures, changes, security issues, or data practices of third-party tools such as Ollama, ComfyUI, or Tailscale
  3. Inaccurate, inappropriate, or misunderstood AI responses or generated content
  4. Data deletion, backup failure, device changes, or app deletion by the user
  5. Natural disasters, communication failures, platform policy changes, app store review outcomes, or other events beyond the operator’s reasonable control

Nothing in these Terms excludes or limits liability where such exclusion or limitation is not permitted by applicable law.

13. Changes to These Terms

The operator may update these Terms when necessary.

When these Terms are changed, the operator will provide notice of the effective date and key changes through in-app notices, documentation pages, or other appropriate methods.

If the user continues to use the Service after the effective date of the updated Terms, the user may be deemed to have agreed to the updated Terms.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Korea.

In the event of a dispute related to the use of the Service, the operator and the user will first attempt to resolve the dispute through good-faith discussions.

If the dispute cannot be resolved through discussion, the competent court under applicable law shall have jurisdiction.
